Post Conviction

For Smith & Zimmerman, PLLC, the fight for justice extends well beyond trial. Our practice includes a significant focus on post-conviction litigation, including alleged probation and supervised release violations. David Smith and Jeffrey Zimmerman are also accomplished appellate attorneys, successfully arguing before state and federal appellate courts, resulting in reversed convictions and lower sentences. In addition, our attorneys fight for individuals by collaterally attacking their convictions and sentences through habeas corpus proceedings and motions filed pursuant to 28 United States Code § 2255.  Messrs. Smith and Zimmerman obtained reversals of numerous convictions for money laundering, structuring, and obstruction of justice on behalf of a client in federal district court in Richmond who was serving a ten year federal sentence. The comprehensive, nearly 200-page § 2255 motion to vacate the conviction was so persuasive that the United States Attorney’s Office decided not to oppose it. Our client, a Richmond car dealer, was released immediately.
